My ISP dosn't allow servers so i'm wondering what kind of server wouldn't be allowed. Is a backup server (with bacula) running on a home network technically a server to them? I'm not sure if it actually uses there bandwidth if it's local. They shut my website down a while ago because of apache and sendmail so I wan to be carefull. Also, samba for a home network isn't outbound so that should be ok right?

They mean anything that's connected to the internet. There's no reason that you shouldn't be allowed to run a samba server on your priviate lan.

Just about every operating system comes with some sort of server or daemon running, so they probably mean web servers. I was talking to a worker for my isp (Comcast cable) and he told me not to let anyone know that I run Apache. He told me that it's somehow possible for me to let neighbors freeload off my connection. Maybe they just don't want people running proxies or other web/mail servers that are easily cracked *cough*IIS*cough*.

I work for BrightHouse Networks / TimeWarner Cable, some ISP providers do scan for servers others dont. Earthlink & AOL, do not scan RoadRunner SBC DSL does.........

But even if they found out it they wouldn't have a problem b/c it's not connected to the internet right?, just the home network. They (Charter cable internet) have a very strict server policy:
Customer may set up one (1) web page per primary e-mail account for personal use using the Service, but Customer may not establish a web page using a server located at Customer’s home. Customer will not use, nor allow others to use, Customer’s home computer as a web server, FTP server, file server or game server or to run any other server applications. Customer will not use, nor allow others to use, the Service to operate any type of business or commercial enterprise. Customer will not advertise that the Service is available for use by third parties or unauthorized users.
